INTRODUCTION : A criminal case is filed by a married woman against her husband, her in-laws, brother-in-law & his wife, sister-in-law & her husband
498 A 1PC : Section 498A was introduced in Indian Penal Code (IPC) in the year 1983 to protect married women
from ‘cruelty’ by the husband or his relatives. It provides for punishment of imprisonment up to three years and fine.
An offence committed under Section 498A IPC is cognizable, non compoundable, and non-bailable. ‘Cruelty’ under
Section 498A IPC has been defined in a broad manner, so as to include: • Any willful conduct likely to drive woman
to suicide or cause her physical or mental harm to the body or health; or • Acts of harassment with a view to coerce
her or her relations to meet any unlawful demand for any property or valuable security. This includes harassment or
demand for dowry |
